Article 1 : General acceptance of conditions of sale
To create and fill out a purchase order on this site and confirmation of this order is full acceptance of all general sales conditions. Article 2: Sales contract conclusion The sale is concluded under Canadian law in accordance with the rules governing distance selling when the Order is validated. The automatic registration system for the order is considered to be proof of the nature of the agreement and and the date of the agreement. Upon receipt of the order, and after validation of the payment, the order is considered accepted by EHS-Canada and an email confirmation is then sent to the buyer, indicating the price of the sale, delivery costs and taxes if applicable. In the same way, EHS-Canada will inform the customer by e-mail if an order is refused.. Article 3 : General obligations of each party 3.1 EHS-Canada Obligation: 3.11 Acceptance of orders EHS-Canada, in the event of acceptance of an order, agrees to sell and deliver the products ordered to the customer. 3.12 Availability The Products presented on the site are normally available and the site is updated after each sale. 3.13 Product information The images on the site illustrating the products are indicative and cannot enter the contractual field. 3.2 Obligation of the purchaser: 3.21 Information In addition to the payment of the order, the purchaser has to indicate to EHS-Canada all necessary information concerning delivery, including an address during business hours. 3.22 Capacity - Minor The parties agree that minors placing orders are acting on behalf of their parents. Article 4 : Price, invoice 4.1 Prices: This order confirmation includes the price of the items, shipping costs and taxes if applicable. For outside Canada, customs fees may be added to the price indicated and are the responsibility of the recipient. 4.2 Invoice: An invoice is provided for each order. 4.3 Modes of payment: Payment for the products is possible with Visa, Mastercard or Paypal. 4.4 Safety of payment: Entry by the customer of his Credit Card Number as well as the expiry date is done on the Online Store or by phone. Article 5 : Transport, delivery 5.1 Costs: Any delivery is tied to the integral and preliminary price. The expenses of packaging, port and route are always the responsibility of the customer. When they are dispatched, the goods always travel at the risk and danger to the recipient. Transport is carried out at our convenience, by, mail service or private conveyor. 5.2 Delivery periods: Delivery periods are not contractual. They are generally 3 to 14 business days for Canada unless otherwise notified by e-mail or phone by a representatives of EHS-Canada. In the event of unavailability or out of stock on an ordered item, EHS-Canada is committed to delivering the article(s) within 60 days. In case of unavailability for temporary or permanent cessation of the production of the item(s) ordered, EHS-Canada agrees to propose to the CONSUMER a similar replacement item or the refund of the order. EHS-Canada Online Store offers are valid until the date indicated on the site or while quantities last. 5.3 Transfer of the risk: The transfer of the risks on the products take place as soon as the products are handed over by EHS-Canada to the conveyor. 5.4 Restrictions: All merchandise should be inspected for any damage in the presence of the conveyor. The client can only return an item in the event that the delivery is not in conformity with the order, or in case of deterioration. In such a case., a note will be included in the bill of lading and the delivery refused. All shipments that are refused by the clients must be confirmed by email or by mail to EHS-Canada Article 6 : Property All items remain the property of EHS-Canada until total payment of the items. Article 7 : Retractation EHS-Canada offers a 7 day (working days) period on all exchange or return of items. The client is responsible for all return fees inherent to transport. All items must be returned in perfect condition. The item may be replaced or refunded. All reimbursements will be made within a 30 day period. Concerning replacement of several items, should the price difference be in favour of EHS-Canada it will be paid by the client by credit card or on his account, before any new shipment. Should the price difference be in favour of the client, EHS-Canada will pay the difference within 30 days. Article 8 : Return policy An invoice must be submitted. All fees and risks encountered during the return of the items is the purchaser's responsibility. No return will be accepted after a delay of 30 working days folowing the date of delivery. Any litigation issues relative to the present contract will be submitted to the legal department of our office. Please verify all items in order to avoid any litigation. Note that if you make a mistake by ordering the wrong product, there will be 10% fee back for re-inventory. It is responsibility's of the purchaser to order the right product. Article 9 : Waranty Exclusion All natural wearing or damages caused by exterial accidents or modifications of the product not approved by the vendor will not be covered in the warranty. Article 10 : Major events EHS-Canada will not be responsible for any clause in the contract regarding damages originating from acts of God, or war, or strike etc. Article 11 : Applicable law Both parties agree that this contract is submitted to Quebec Law and that the english language will prevail over any other translation. Article 12 : Competence Should there be any contracdictions regarding the interpretation or the execution of the present conditions, express competence will be assigned to the Quebec courts.
